In difficult cases, developing a litigation strategy is often easier than executing it. In criminal defense especially, I’ve seen many attorneys develop a strategy but are unable execute it. In speaking with these attorneys the conversation often ends with their opinion of a strategy, as they avoid talking about how to execute it. The best attorneys are the ones who know how to execute their strategy.

While not knowing how to execute a strategy is where many attorneys stumble, they also fail logistically. Lack of follow-through, or simple inertia can keep cases from moving forward.
EFFICIENCY MATTERS
In many cases, strategies never get off the ground. Lawyers might suffer from analysis paralysis, or don’t execute their plan quick enough, forcing them to resolve the case or head to trial before they’re truly ready. This often leads to bad results as the lawyer is forced to proceed without being fully prepared. Good lawyers can often out litigate their opponent.
STAY ON TOP OF YOUR CASES
Benjamin Netanyahu once said he improved the efficiency of the Knesset by 50% simply by appointing someone to oversee the agenda. The same principle applies to legal practice: investing time to regularly review your cases pays off. One attorney, known for resolving cases allegedly went over all his cases with his paralegal every morning.
